By creating an account or using Santa Wishlist, you agree to them. If you do not agree, please do not use Santa Wishlist. ## Who can use Santa Wishlist Santa Wishlist is for adults to use with their children. You must be 18 or older and a parent or guardian to create an account. You hold the phone, you are responsible for how it is used, and you are responsible for anything your child does with it. ## What Santa Wishlist is Santa Wishlist is a family entertainment app. You send a photo or a message "to Santa," an AI writes a reply in Santa's voice, and a private gift list is kept for you. It is fiction and fun. It is not advice, and it is not a promise. - Santa's replies are generated by AI and reviewed by automated safety filters. - A reply does not promise that any child will receive any item. You decide what to buy. - Item names and prices on your list are best guesses taken from your photo or message. Check them before you buy. - We are not affiliated with any toy maker, store or brand shown in your photos. ## Your account and your PIN Keep your sign-in details and your Parent PIN private. You are responsible for activity on your account. Tell us at once if you think someone else has access. ## Free messages, Candy Canes and the Season Pass New accounts get 10 free Candy Canes. A text message uses 1 cane and a photo message uses 2. You can buy more packs, or the Whole Season Pass, which gives your whole family a total allowance of 1,200 messages to use any time until December 31, 2026. When the season allowance is used up you can keep chatting with Candy Canes. We may change the allowance for future purchases, with notice. No auto-renewing subscriptions. Nothing renews. > **No cash value** > > Candy Canes are for use in Santa Wishlist only and have no cash value. They cannot be transferred, sold or redeemed for money. - Purchases are made through the App Store or Google Play and are charged by them. Their payment terms and refund policies apply. - A reply that fails or is blocked by the safety filters does not cost any canes. - Your gift lists, photos and chats are not deleted if your balance reaches zero. Only sending new messages is paused. - The Season Pass ends on the date shown when you buy it and does not renew. ## Family members - The account owner can invite family members, up to three more people, with a link or a code. - Invited people can see the kids, their chats with Santa and the wish list. - The owner is responsible for who they invite and for sharing invite links only with people they trust. - Anyone can leave a family at any time, and the owner can remove anyone. ## Using Santa Wishlist well Please do not use Santa Wishlist to send anything unlawful, hateful, sexual or harmful, to harass anyone, to try to break or probe our systems, to copy or resell the service, or to get around the safety filters or the Candy Cane system. Photos should be of toys, products and everyday family moments. Do not send photos of other people's children. ## Your content You keep ownership of the messages and photos you send. You give us permission to store and process them, and to send them to our service providers, only as needed to run Santa Wishlist for you, as described in our [privacy policy](/privacy). You promise that you have the right to send what you send. ## Safety filters Messages and replies pass through automated filters. We may block, change or remove content that breaks these terms or that the filters flag. Filters can make mistakes in both directions. ## Ending your account You can delete your account at any time from Settings, as explained on our [delete account page](/delete-account). We may suspend or close accounts that break these terms or that put others at risk. ## Disclaimers Santa Wishlist is provided "as is" and "as available." We do our best to keep it running, especially in December, but we cannot promise it will always be available or error free, and AI replies may sometimes be odd or wrong. ## Limits on our liability To the extent the law allows, Enzak LLC is not liable for indirect, incidental or consequential damages arising from your use of Santa Wishlist, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you. ## Governing law These terms are governed by the laws of the State of California, and disputes will be handled in the state or federal courts located in Orange County, California, except where the law of your home place says otherwise. ## Changes We may update these terms. If we make a meaningful change we will update the date above and let you know in the app or by email. Using Santa Wishlist after a change means you accept it. ## Contact Questions?
